This Privacy Policy (“Policy”) describes how Stratford Berkshire Group, LLC d/b/a Berkara (“Berkara,” “we,” “us,” or “our”) collects, uses, stores, and discloses personal information obtained from users of its websites, software applications, and related services (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read and understood this Policy and agree to the collection and use of information in accordance with it.
Introduction and Scope
Berkara is a business-to-business Software-as-a-Service (SaaS) platform headquartered in Colorado, United States. This Policy applies to all users of the Services, including business clients and their authorized representatives. It governs both online and offline collection of information in connection with the Services.
Information Collected
Berkara collects personal information that is voluntarily provided by users, such as name, company name, contact details, login credentials, billing information, and correspondence sent to Berkara through support channels.
Berkara also automatically collects certain technical data when users access the Services, including device identifiers, IP addresses, browser type, time zone, referring URLs, usage data, and analytics information obtained through third-party tools such as Google Analytics.
In providing the Services, Berkara’s clients may upload, store, or transmit data relating to their own customers or operations. Berkara processes such data solely on behalf of its clients and in accordance with their written instructions. Berkara does not control or own such client data and acts only as a data processor with respect to that information.
Use of Information
Berkara uses collected information to provide, operate, maintain, and improve the Services; to authenticate users and manage accounts; to process payments and subscriptions through Stripe; to communicate with clients and respond to support inquiries; to ensure security and prevent fraud; to analyze and enhance performance; and to comply with applicable legal or regulatory requirements. Berkara does not sell, lease, or trade personal information to any third party.
Legal Bases for Processing (GDPR)
Where the General Data Protection Regulation (GDPR) applies, Berkara processes personal data under one or more of the following legal bases: the processing is necessary for the performance of a contract with the user or the user’s organization; the processing is necessary for Berkara’s legitimate business interests, such as maintaining and improving the Services; the user has provided consent, where required; or the processing is necessary to comply with legal obligations.
Disclosure of Information
Berkara may disclose personal information to trusted third-party service providers that perform services on its behalf, including payment processing by Stripe, data analytics by Google, hosting, and technical support. Such providers are authorized to use the information only as necessary to provide services to Berkara and are bound by confidentiality and data-protection obligations consistent with applicable law.
Berkara may also disclose information if required to do so by law, in response to lawful requests by public authorities, or to protect its rights, property, or safety. In the event of a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction, subject to confidentiality protections.
International Data Transfers
Information collected by Berkara may be transferred to, stored in, and processed in the United States or other jurisdictions where Berkara or its service providers operate. Berkara implements appropriate safeguards, including Standard Contractual Clauses approved by the European Commission where applicable, to ensure that personal data transferred from the European Economic Area or the United Kingdom receives an adequate level of protection.
Data Retention
Berkara retains personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal obligations, to resolve disputes, and to enforce agreements. When information is no longer required, it is securely deleted or anonymized.
Rights of Data Subjects
Individuals located in the European Economic Area or the United Kingdom have the right, under the GDPR, to request access to, correction of, or deletion of their personal data, to restrict or object to processing, and to request data portability. Requests may be submitted to support@berkara.com.
California residents have rights under the California Consumer Privacy Act (CCPA) to request disclosure of the categories and specific pieces of personal information collected, to request deletion of personal information, to opt out of the sale of personal information (Berkara does not sell personal information), and to be free from discrimination for exercising their rights. Requests under the CCPA may also be submitted to support@berkara.com. Berkara will respond to all verified and lawful requests within the time periods required by applicable law.
Security
Berkara employs administrative, technical, and physical measures designed to protect personal information from unauthorized access, alteration, disclosure, or destruction. While Berkara strives to maintain a secure environment, no method of transmission or storage is completely secure, and users acknowledge this inherent risk.
Children’s Privacy
The Services are intended for use by business entities and individuals over the age of eighteen (18). Berkara does not knowingly collect or maintain personal information from minors. If Berkara becomes aware that information has been collected from a minor without verifiable parental consent, such information will be deleted promptly.
Third-Party Websites and Services
The Services may contain links or integrations to external websites or third-party services that are not operated by Berkara. This Policy does not govern those external sites, and Berkara assumes no responsibility for their content or practices. Users are encouraged to review the privacy policies of any external websites they visit.
Changes to This Policy
Berkara reserves the right to amend or update this Policy at any time to reflect changes in legal requirements or business practices. The updated Policy will be posted on Berkara’s website with a revised “Effective Date.” Continued use of the Services following such publication constitutes acceptance of the updated terms.
